Welcome to Urban Sunset Safaris (“Company,” “we,” “our,” or “us”). These Terms & Conditions govern your use of our website, booking platform, and travel services. By making a booking or using our services, you agree to be bound by these Terms & Conditions.

1. About Urban Sunset Safaris

Urban Sunset Safaris specializes in organizing and facilitating:

  • Wildlife safaris
  • Group tours
  • Private tours
  • Day trips and excursions
  • Holiday packages
  • Airport transfers
  • Accommodation bookings
  • Custom travel experiences

All bookings are subject to availability and confirmation.

2. Booking Confirmation

A booking shall only be considered confirmed when:

  • The required deposit or full payment has been received;
  • Availability has been confirmed;
  • A booking confirmation has been issued by Urban Sunset Safaris.

We reserve the right to decline or cancel bookings where payment has not been completed within the stipulated period.

3. Pricing and Payments

  • All prices are quoted in the applicable currency as indicated during booking.
  • Prices are subject to change without prior notice until a booking is confirmed.
  • Full payment must be completed before the commencement of the trip unless otherwise agreed in writing.
  • Any bank charges, transfer fees, or payment processing charges shall be borne by the customer.

4. Cancellation Policy

Customer Cancellations

Urban Sunset Safaris understands that plans may change. The following cancellation policy applies:

✅ Cancellations are allowed up to 7 days before the scheduled trip date.

✅ Cancellation requests must be submitted in writing through email, WhatsApp, or other official communication channels.

❌ Cancellations made 1 day before the safari date or on the safari date without providing a replacement participant will result in NO REFUND.

❌ Any deposit paid shall be retained to cover third-party reservations, bookings, and administrative expenses.

❌ No refund shall be issued for failure to attend the trip (No-Show).

5. Changes to Bookings

Any request to:

  • Change travel dates
  • Change destinations
  • Transfer bookings
  • Replace travelers

shall be subject to availability and approval.

Additional charges may apply depending on supplier policies and existing reservations.

6. Travel Documents

Travelers are solely responsible for ensuring they possess:

  • Valid identification documents
  • Passports
  • Visas (where applicable)
  • Vaccination certificates
  • Any other required travel documents

Urban Sunset Safaris shall not be liable for denied travel resulting from incomplete or invalid documentation.

7. Traveler Responsibilities

All travelers are expected to:

  • Follow instructions provided by guides and tour leaders.
  • Respect fellow travelers, wildlife, and local communities.
  • Comply with park regulations and local laws.
  • Conduct themselves responsibly throughout the trip.

Urban Sunset Safaris reserves the right to remove any traveler whose conduct endangers others or disrupts the experience. No refund shall be provided in such circumstances.

8. Health and Safety

Travelers participate in tours and activities at their own risk.

Customers are responsible for:

  • Disclosing relevant medical conditions that may affect participation.
  • Carrying any required medication.
  • Following safety instructions issued during the trip.

Urban Sunset Safaris shall not be liable for injuries, illnesses, accidents, or losses arising from participation in activities except where required by law.

9. Force Majeure

Urban Sunset Safaris shall not be liable for delays, cancellations, modifications, or disruptions caused by circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters
  • Floods
  • Severe weather conditions
  • Government restrictions
  • Political unrest
  • Pandemics
  • Transportation disruptions
  • Acts of terrorism

In such cases, refunds and rescheduling options shall be subject to third-party supplier policies.

10. Limitation of Liability

Urban Sunset Safaris acts as an organizer and facilitator of travel services.

We shall not be held responsible for:

  • Acts or omissions of third-party suppliers;
  • Delays or cancellations by transport providers;
  • Loss, theft, or damage to personal belongings;
  • Injuries, illnesses, or accidents occurring during travel beyond our reasonable control.

Our liability shall be limited to the amount paid directly to Urban Sunset Safaris for the affected booking.

11. Photography and Marketing

Urban Sunset Safaris may capture photographs and videos during trips for promotional and marketing purposes.

By participating in our tours, you permit us to use such media unless you expressly notify us otherwise before the trip.

12. Privacy

Personal information collected during bookings shall be used solely for the purpose of providing travel services, communicating with customers, and improving our services.

We do not sell customer information to third parties.

13. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Kenya.

Any disputes arising from these Terms shall be subject to the jurisdiction of Kenyan courts.
